3/5 Big Mistakes to Avoid in your Personal Injury Case – Failing to Contact an Experienced Personal Injury Lawyer
One of the biggest mistakes you can make when dealing with a potential personal injury case is failing to contact an experienced personal injury lawyer right away. By contacting a lawyer, the lawyer is going to be able to know to preserve evidence, investigate the scene, and to have our investigators contact witnesses.
It is the plaintiff’s burden of proof to prove the case. If evidence is lost in the meantime, it only hurts your case. In a product liability case, you must preserve that product, in the same condition it was in at the time it caused the injury. In the case of a trip and fall you’ve got to be able to document what the hazard was, and that the hazard was a condition that was unsafe and caused the injury, the way you do that is by getting there early on. The same situation with witnesses, independent witnesses can turn a case; and we want frankly, our investigator to get the witnesses and evidence first.
The other thing we can do if we are contacted early on in a case is, give clients good advice on how best to utilize the available insurance coverages to make sure the medical bills are paid and paid right away. Studies have shown that people who have lawyers represent them in injury claims, recover more even after the lawyer’s fees are paid than people who deal directly with the adverse insurance companies.
