Following your doctor’s orders is extremely important when dealing with personal injury. Now, when you’re in a personal injury case, all of your medical visits, your medical treatments are going to be very closely scrutinized by the insurance company and their lawyers. Remember, nobody believes what you say, they don’t believe what we say, that means the medical records become very important. The insurance company assumes you’re either a scammer or somebody trying to exaggerate their case to make a profit.
If your doctor recommends testing and MRI, EMG for their x-rays, make sure you go for those tests. Then you’ll be able to get to the bottom of whether you have a serious structural or nerve problem, or if your injury is connective tissue or muscle-related and hopefully will resolve quicker than something more serious. Your doctor recommends further treatment of physical therapy, injections, chiropractic, go for that treatment. The doctor’s recommending it to you for a reason. If a doctor recommends surgery, that is a much more serious consideration. Nobody really wants to have surgery. Under the law, your failure to have surgery cannot legally be used against you; however, people on the jury may wonder why you didn’t want to follow through with a procedure, that was recommended, that may have helped you.
If you continue to have problems even though you’ve followed your doctor’s recommendations, don’t just stop going to the doctor, return or seek a second opinion. Finally, if you do go to a second opinion doctor make sure you give that doctor your complete and accurate medical history because otherwise, it can look like you are trying to hide something from that doctor or provider.
